This privacy policy has been compiled to better serve those who are concerned with how their "Personal Identifiable Information" (PII) is used online and at the Clinic. PII, as described in the European Privacy, Information, and Security Law, is information that can be used on its own or with other information to identify, contact, or locate an individual, or to identify an individual in a specific context. Data Controller

Purpose of Data Processing

The personal data provided by the respective Data Subject at the time of their admission to the Clinic (such as name, surnames, identification document, postal address, clinical data, and email address, as well as data provided in the future as a result of their development) will be included in a data processing record owned by B2B, for the following purposes:

a) Provide, manage, control, and maintain the services related to your treatments and clinical follow-up.

b) Manage the creation of a unique Customer ID within our Management Software and Clinical records.

c) Maintain a direct relationship with the customer for promotional and/or statistical purposes (including profile segmentation to adapt offers and marketing activities to each customer) related to activities carried out by B2B, through conventional and/or electronic means (emails, SMS, purchase receipts, etc.).

d) Conduct segmentation and profiling work by analyzing the use of the services provided, with the aim of adapting offers and marketing activities to each customer, offering personalized products and services.

e) Provide the requested information and services, whether through the Internet, email, or telephone. In addition, emails may provide confirmation of their receipt and reading.

f) Respond to incidents that may occur, as well as conduct satisfaction surveys regarding the contracted product or service. Contact the customer if there are detected or well-founded suspicions of possible fraud or identity theft.

g) Depending on the case, manage the fulfillment of pecuniary obligations in relation to breaches that may occur on the part of the customer. In this regard, the consultation of files related to the breach of pecuniary obligations may lead B2B, as a Service Provider, to make decisions with legal effects or affecting the customer, and as a consequence, prevent the implementation or suspend the treatment(s) or condition their validity on the provision of a payment guarantee. However, B2B will always grant the customer the opportunity to assert anything they consider relevant in order to defend their rights or interests.

h) Manage customer data as a user of the Website, including data collected in appointment booking or contact forms.


Personal Data of Third Parties

If the personal data provided belongs to third parties, the Customer guarantees that they have informed such third parties about this Privacy Policy and have obtained their express authorization to provide their data to B2B for the mentioned purposes. They also guarantee that the provided data is accurate and up-to-date, and they are responsible for any direct or indirect damage that may occur as a result of non-compliance with this obligation.


Retention Period of Personal Data

The personal data provided will be retained during the duration of the clinical relationship and beyond, unless deletion is requested by the interested party, and they will be retained to the extent necessary to comply with legal obligations or for the preparation, exercise, and defense of claims.

If the Customer revokes their consent or exercises the rights of cancellation or deletion, their data will be kept blocked and made available to official public authorities for the legally established periods to respond to possible liabilities arising from the processing of such data.


Legitimacy for Data Processing

The legitimacy for the processing carried out is based on:

a) The fact that the Customer has provided their personal data in the context of pre-contractual or contractual relationships, and as such, the processing is necessary for the maintenance of that relationship.

b) Applicable legal obligations on B2B that require the processing of personal data for the purposes of the services provided.

c) The legitimate interest of B2B, regarding processing that is strictly necessary for the prevention of fraud during contracting, or concerning the sending of commercial communications directly related to the requested services.

d) The Customer's consent for all other cases, including the sending of commercial communications related to third-party products, services, benefits, and/or advantages, always through B2B, for advertising or promotional purposes, for the installation of monitoring systems that provide information about browsing habits, as per the Cookie Policy, or for the use of information related to their geographical location. The withdrawal of this consent does not, under any circumstances, affect the provision of clinical services.


Source of Personal Data

The personal data processed by B2B for the provision of the requested service has been largely provided directly by the Customer during the admission process, such as name, surnames, address, contact information, and clinical data. The Customer is responsible for its accuracy and currency.

Additionally, B2B may obtain information collected through the internet, as well as through the use of the requested service, such as statistical or browsing data, or, as the case may be, information related to interests and consumption.

B2B will use a statistical tracking system from Google, Google Analytics, to analyze the behavior of users on its website (www.back2balance.pt). No personal data is collected during this process.


Transfer of Personal Data and Recipients

All data transfers will be carried out by B2B because they are necessary to fulfill the mentioned purposes or will be made to comply with a legal obligation to the following Public Entities and Organizations:

a) Official Public, Administrative, or Judicial Entities. b) Companies providing creditworthiness, credit, and fraud prevention services, for risk analysis and the verification or cross-referencing of your data to verify their accuracy and truthfulness, and to payment service providers. c) Companies and entities partnering with B2B for the organization, management, and/or promotion of contests, events, promotions, or drawings if the Participant has chosen to register and/or participate in them.


Customer Rights

The Customer may exercise, with Back2Balance, their rights of access, rectification, or deletion, limitation of processing, opposition, portability, and the right to object to automated individual decisions. Additionally, they may revoke their consent if given for a specific purpose, and change their preferences at any time.

Customers can exercise their rights by sending a written communication to the email address general@back2balance.pt or by sending a letter to the following address: Rua Poeta Bocage 18A, 1600-581 Lisbon, Portugal. Customers may file complaints regarding the protection of personal data with the National Data Protection Commission (www.cnpd.pt), the Supervisory Authority in Portugal.
